Cholera Petition Suggests UN Caused “Involuntary Genocide” in Haiti

The United Nations is faced with two substantial legal petitions on behalf of cholera victims in Haiti and the Dominican Republic. The actions could not be more different in their demands, tone, jurisdictions and venues. Both petitions address the serious grievances of the residents of Hispaniola, but they differ in what constitutes the impetus for reparation.

Should recompense depend solely on the law of man, or is there a higher moral imperative that must drive these demands? In short, what international body is best equipped to provide compensation for victims of cholera? Will a moral argument ultimately sway the discussion? Will the inclusion of the word “genocide” help or harm the argument?

The Faculdade de Direito de Santa Maria, Brazil (FADISMA) filed a complaint with the Commission on Human Rights of the Organization of American States (IACHR) demanding that the United Nations accept full responsibility and offer reparations for the actions of the MINUSTAH military base located in Mirebalais, Haiti. Human waste infected with cholera was dumped into the rivers and tributaries in October 2010, resulting in over 500,000 infections and at least 6,700 deaths in Haiti, in addition to 17,206 infections and 303 deaths in the Dominican Republic.

According to the FADISMA complaint, the UN is in violation of Articles 4 (right to life) and 5 (right to humane treatment) of the American Convention on Human Rights. In addition, the UN is in violation of the explicit purposes of the Charter of the United Nations, in Article 1, paragraph 3 (promoting and encouraging respect for human rights).In a separate action, The Institute for Justice and Democracy (IJDH) in Haiti and its Haiti-based affiliate, the Bureau des Avocats Internationaux, filed a petition on November 3 with the Office of the United Nations Secretary General in New York. The organization (s) is seeking damages on behalf of more than 5,000 Haitian cholera victims and their families. The claim asks the UN to compensate victims ($100,000 dollars for each death and $50,000 for each person made sick) and provide the clean water infrastructure necessary to control an epidemic that continues to rage, unabated. The IJDH lawsuits are receiving major media attention and prompted demonstrations on December 9 when several thousand Haitians protested at the MINUSTAH base in St. Marc, Haiti to demand a response from the UN for its role in the cholera outbreak.The worthy IJDH petition, which demands that the United Nations prosecute itself, might be a non sequitur. Since the United Nations is immune from prosecution according to a 1946 treaty, IJDH is already fighting a losing battle.In a portent of denials to come, U.N. spokesperson Martin Nesirky told a press conference he rejected the claim of U.N. responsibility for the cholera outbreak. Note Nesirsky’s comments at one minute into this Aljazeera report.

The UN has yet to respond to victims’ claims and has “declined to give a time­line for a response,” according to a recent IJDH press release.

Awareness of the UN’s inability to police itself, from the notorious conflagration in Kivu Province in eastern DRCongo, to the totally under-reported lead poisoning of Roma people in Kosovo on UN land, is critical to establishing an understanding of the UN’s malfeasance. This historical litany of human rights violations and abuse perpetrated by the UN suggests that the FADISMA complaint may have the best chance of success. It certainly has the impetus of a moral imperative, since it focuses on moral reparatory action rather than a lawsuit based solely on financial reparation that could take decades to resolve. Meanwhile, clean water remains an elusive hope for the Haitian people. The sooner reparations in the form of infrastructure are in place, the better for the untold thousands of Haitians at continuing risk of infection.

The FADISMA petition is profound in its direct simplicity and call for morality. It is well worth reading in its entirety and presents some unique moral arguments to the international community.

The Petitioner demands the Commission (OAS) to recognize and declare the international responsibility of the United Nations Organization for the contamination and sickening of tens of thousands of people infected by Vibrio Cholera in Haiti

The petition also calls for a fund of at least $500,000,000 to create a public health system in Haiti. In addition, the UN would be required, at its own expense, to hire independent consultants to assess “the amount of reparation for moral and material damages caused to the State of Haiti and the State of the Dominican Republic, as well as the families of the victims.”

The key here is that the UN would not be policing itself if the OAS takes up the matter.

Culpability hinges on the assertion that the United Nations did not test the health of Nepalese soldiers contaminated by Vibrio Cholera in their homeland before they assumed duties and responsibilities under the United Nations. In addition, the United Nations allowed contaminated fecal material to discharge into the Meille River thereby allowing the waters to be contaminated by “omission and negligence.”

In an email interview, Cristine Koehler Zanella, Professor of International Law and International Organizations and Vice-Supervisor of Project Brazil-Haiti, suggested that by-passing the United Nations via the OAS Commission on Human Rights is a unique opportunity to effect real change and reparation based upon moral duty. Although this is FADISMA’s first first formal action on behalf of Haiti, it has documented human issues there since 2007.

From proven facts we built up legal arguments that allowed us safely to conclude that this case represents an unparalleled opportunity for the Inter-American System of Human Rights to assert, in the regional arena, the international responsibility of international organizations to act against omission, negligence and impunity of international interests. The cholera epidemic, due to the well-known victim’s [Haitians] lack of means and difficulty to access to justice, could perpetuate as an unpunished historic fact, with no legal consequences, attributed to a “convergence of circumstances.”

Zanella terms the UN denial of culpability through the “convergence of circumstances” in the UN Final Report on the Cholera Epidemic in Haiti an “unacceptable point of view.”

“Apart from all legal issues, our petition addresses moral responsibility. The UN cannot be immune from its responsibilities,” Zanella said.

“The UN more than once refused to scrupulously investigate the origins of cholera and denied a prompt answer to the outbreak. Acting in this manner increased the potentiality for losses and provoked irreparable damages to the people contaminated, their families and, due to the proportions of the epidemic, to the whole Hispaniola Island, home of the Haitian and Dominican nations.”

Is the Inter-American Commission on Human Rights, one of two bodies of the Inter-American System for the promotion and protection of human rights, the best hope for reparation?

The Commission has its headquarters in Washington, D.C. The other human rights body is the Inter-American Court of Human Rights, which is located in San José, Costa Rica. The IACHR is part of the Organization of American States (OAS).

georgianne nienaberPart of the mandate of IACHR requests “States to adopt specific precautionary measures to avoid serious and irreparable harm to human rights in urgent cases. The Commission may also request that the Court order provisional measures in urgent cases which involve danger to persons, even where a case has not yet been submitted to the Court.”

Haiti is certainly an “urgent case” and her people are experiencing “serious and irreparable harm.”

The FADISMA petition says that due to the fact that the United Nations “was undoubtedly and seriously negligent, due to omission, it should therefore be blamed for “involuntary genocide.” (Section 28; page 15)

The use of the “g” word, however “involuntary,” might get some attention.

Still, Zanella makes a good argument for this OAS venue.

“This is really the opportunity for a region that has its own system of human rights protection to declare that such ‘involuntary genocide’ without the proper responsibility is not acceptable. We sincerely hope that the Inter-American Commission on Human Rights will have the courage to answer in an affirmative way to this unique opportunity,” Zanella said.

georgianne nienaberRegarding the IDJH lawsuit delivered to the UN, Zanella says that both FADISMA and IDJH are fighting for the same people, but “if you demand the recognition and declaration of international responsibility of an organization to the organization itself, the probability of success is little. The UN should not be legibus solutus (above the law).”

Regarding Zanella’s hope for courage on the part of the IACHR, and in the words of Alexander Pope’s Moral Epistles, “hope springs eternal” in the minds and hearts of the Haitian people.

It might be a long wait. As of this writing, there has been no response from the IACHR.

    I hope we can get back to Haiti next year too, Georgianne!

    Regarding “genocide”, words quite often simply serve as triggers for emotions and heavy associations, which is why I think the word genocide should always be carefully used, although I also see it abused so much by various writers trying to push hot buttons out there that the original emotional impact is being diluted. The word has recently been flung around with open abandon way too much, to the point where it begins to invite skepticism. Yes mistakes can be truly heinous, like the BP oil spill, but you saw how the never-ending crop of conspiracists attempted to take control of that issue too, even I got sucked into it a bit, and before you knew it, we had some of this genre calling the BP oil spill a conspiratorial genocide against the American people, one “pundit” even telling us how the “lizard people” are behind it..

    Ohhh, I don’t like that the word genocide in this context. You cannot escape the associations with WILLFUL mass murder of a race or ethnic group however you use the word, and that immediately begins to feed some of the conspiracy theories floating around Haiti and elsewhere. But definitely we DO have a case for mass, negligent homicide or manslaughter. MINUSTAH, with rather great certainty, did screw up really badly by all accounts except their own.

    The legal options via the various political bodies are quite well laid out by Georgianne, but BOTH may take a long time. Haiti should really try to get this whole debacle brought up on the floor of the UN General Assembly via a pressing and relevant resolution, where it will likely garner more international attention quickly and hopefully even lead to something positive. But then that would mean that President “Sweet Micky” Martelly will have to do something decisive and strategic at the UN, and is he even up to that task? More worrisome still, what is HE and his government doing to build a proper sanitation system for Haiti right now? The UN can give Haiti a trillion dollars, but if the government has no will to employ it properly and instead lets the same old culture of corruption swarm all over it, there will still be no viable sanitation system 10 years from now. Both the UN and the Haiti government have to have their feed held to the fire here.

      I know what you are saying, Mac, but that is the fact of the petition, and while I was thinking about the context I remembered Rwanda and all of the dithering over the use of the “g” word. And then I looked around and remembered at least a half a dozen other ethnic groups, not to mention our Native American population and decided it was at least something readers should think about. The inclusion of the word “involuntary” forces one to think about morality and consequences. Is an act any less heinous because it was a “mistake?”

      What abut all of the uranium buried under Indigenous territory here in the US by the US military that Winona LaDuke writes so eloquently about in the “Militarization of Indian Country?” Will it become an “involuntary genocide?”

      Thanks for your always unwavering support regarding Haiti. I think we should go back next year.
