2000 Americans Ask New York Attorney General to Request Federal Court Order for Repeat of New York Primary

Thus far it has been signed by almost 1800 people asking that Schneiderman file in the appropriate court at the Federal level for an Order that New York State repeat and redo its primary election for the Democratic party.

We believe that it should be entered into the Federal level for at least three reasons:

  • Federal Courts have jurisdiction
  • This will save time as any state court's decision would undoubtedly be appealed to higher courts and
  • the Clinton leadership council or Committee of 100 is inextricably entwined with every level of the state judiciary and we could hardly expect to find unbiased judicial decisions in the statewide level courts.

Some of our group have pointed out their grave trepidations about Eric Schneiderman having been announced as a member of the Clinton Leadership Council.

Five days ago, this petition was written out of concern for the manifest egregious abuses that are hijacking our democratic election processes. Other states had problems, like Arizona and Nevada, but New York's egregious primary was beyond intolerable.

However, because of his position, and the statutory responsibilities of his position, he can hardly decline to take action out of "loyalty" to Clinton. If we perceive any balking or intransigence in his reaction to this petition, we have alternatives to whom the petition can be given; the principles remain intact.

This effort is not part of the Sanders campaign in any way, although we have apprised them of it, as well as Senator Sanders' campaign lawyer, Brad Deutsch of the Garvey, Schubert, and Barer Firm in Washington DC.

We see no other correction possible except for completely repeating it, with scrutiny and observers in place to prevent computer fraud, vote "flipping," disenfranchisement that unprecedented in American history, or since Tammany Hall days. Ostensibly impartial appointed officials can investigate and conduct audits and recount ballots all they want, but the whole thing needs to thrown out the window and done over.

I was so moved by signers' comments on the petition that I compiled almost all of them and published them them yesterday on OpEdNews.com, a liberal news site for cutting edge political journalism. They can be quoted in new articles or in your own editorials. Some of the strongest are from New Yorkers.

I have suggested to Brad Deutsch that other states' flawed election "results" should be de-certified by courts if there is documented evidence of fraud or disenfranchisement, even by requested injunctions. For example, what lies beneath the surface of the recent Pennsylvania primary without any paper trail, and all voting strictly on a computer screen? I personally watched an entire county in Delaware in before-and-after screen shots of that county's vote being "flipped."

Senator Sanders and his lawyer will take the legal action they deem appropriate. To make very clear: our effort is entirely independent of Mr. Deutsch's because this directed to the Attorney General of New York.

Certainly Mr. Deutsch could potentially join in as a co-plaintiff, and others by amicus curiae briefs. In most other states, this could be achieved if Petitions for Writs of Mandamus were granted.

Finally, Americans patiently waited while the Bush I appointees on the US Supreme Court decided to give Florida's "hanging chads" (and thus the White House, too) to Bush II. If the United States has to wait a few extra weeks or months for several of the 2016 primaries to be done honestly and fairly and accurately, so be it.
